Welcome to Spooky Vault! The terms "we," "us," and "our" refer to Spooky Vault. Spooky Vault operates this store and website, including all information, content, features, tools, products, and services related thereto (the "Services"). Spooky Vault operates using Shopify technology, which allows us to provide you with these services.
These Terms of Service, together with any policies referenced in this document (these "Terms"), describe your rights and responsibilities when using the Services. By visiting, interacting with, or purchasing from Spooky Vault, you agree to be bound by these Terms and our Privacy Policy. Continued use of the Services constitutes your full, unconditional, and irrevocable acceptance of these Terms.
If you disagree with these Terms, you should refrain from using our Services.
SECTION 1 – ACCESS AND ACCOUNT
By accepting these Terms, you affirm that you are of legal age in your jurisdiction of residence. You are solely responsible for the security of your credentials and all activity conducted under your account, whether authorized by you or not. Spooky Vault is not responsible for unauthorized access resulting from user negligence in protecting their data.
Spooky Vault reserves the right to suspend, restrict, or terminate any account at its sole discretion, without any obligation to provide a reason.
SECTION 2 – OUR PRODUCTS
We have made a reasonable effort to accurately represent our products. However, we do not guarantee that the colors, textures, sizes, or finishes displayed on screen will exactly match the physical product, as these factors can vary depending on the customer's device.
Spooky Vault reserves the right to modify product descriptions, discontinue products, limit quantities per customer or region, and correct catalog errors at any time, without prior notice, and without incurring any obligation to compensate the customer.
SECTION 3 – ORDERS
Placing an order constitutes a purchase offer, not a confirmed purchase. Spooky Vault reserves the absolute right to accept, modify, or reject any order for any reason, even after payment has been processed. In the event of rejection, any refund (if applicable) will be limited to the amount actually charged, with no further obligation on the part of Spooky Vault.
Once the order has been accepted, cancellation or modification requests are not accepted. It is the customer's sole responsibility to review the order before confirming payment.
Returns and exchanges are governed solely by our current Return Policy, which takes precedence over any other expectations of the customer.
The customer declares that their purchase is solely for personal use, and that resale or commercial export is prohibited without express, written authorization from Spooky Vault.
SECTION 4 – PRICES AND BILLING
Prices, discounts, and promotions are subject to change without prior notice and do not apply retroactively to existing orders. The price applicable is the one in effect at the time the order is confirmed.
Prices do not include taxes, shipping, or handling/customs charges, unless otherwise specified.
The customer warrants that the payment information provided is accurate and that they are authorized to use the specified payment method. Any rejected payment, unauthorized transaction, or payment dispute initiated without justification may result in the permanent suspension of the customer's account and actions to recover the corresponding amounts.
SECTION 5 – Shipping and Delivery
All estimated delivery times are approximate and do not constitute a guarantee. Spooky Vault will not be responsible for delays caused by shipping companies, customs, weather conditions, or any other circumstance beyond our direct control.
The risk of loss or damage to the product transfers to the customer once Spooky Vault delivers the package to the shipping company. Claims for loss or damage in transit should be handled according to the Return Policy.
SECTION 6 – INTELLECTUAL PROPERTY
All content of the Services – including trademarks, text, images, designs, logos, and the name "Spooky Vault" – is the exclusive property of Spooky Vault or its licensors, and is protected by intellectual property laws.
Personal and non-commercial use only is permitted. Reproduction, distribution, modification, or exploitation of any content is strictly prohibited without prior written authorization. Unauthorized use may result in legal action.
SECTION 7 – OPTIONAL TOOLS
Any third-party tool offered through the Services is provided "as is," without any warranty from Spooky Vault. The use of such tools is at the customer's own risk.
SECTION 8 – Third-Party Links
Spooky Vault is not responsible for the content, policies, or practices of third-party websites linked to our services. Any transactions or interactions with such third parties are the sole responsibility of the user.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
The Spooky Vault opera using Shopify technology, which allows for direct transactions between the customer and Spooky Vault. Shopify is not responsible for any aspect of the sale, including injuries, damage, or losses resulting from the purchase. The customer expressly releases Shopify and its affiliates from any claims related to their transaction with Spooky Vault.
SECTION 10 – PRIVACY POLICY
The use of the Services is subject to our Privacy Policy. By using the Services, the user acknowledges that they have read and accepted the policy, including the processing of their data by Shopify and third-party partners involved in operating the store.
SECTION 11 – COMMENTS AND REVIEWS
Any comment, review, suggestion, or content submitted by the customer ("Submission") grants Spooky Vault a perpetual, worldwide, irrevocable, and royalty-free license to use, reproduce, modify, publish, and distribute said Submission for any purpose, including commercial and advertising purposes, without any compensation to the customer.
Spooky Vault reserves the right to delete, modify, or reject any Comment at its sole discretion, without being required to provide a reason.
SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS
Spooky Vault reserves the right to correct typographical errors, pricing errors, or availability errors at any time, even after an order has been placed, without incurring any additional liability to the customer beyond the refund of the amount paid for the affected item.
SECTION 13 – PROHIBITED USES
The user agrees not to use the Services for illegal, fraudulent, defamatory, or otherwise infringing purposes, or to interfere with the security or operation of the website. Spooky Vault reserves the right to immediately and without prior notice suspend or terminate any account that violates this section.
SECTION 14 – AUTOMATED AGENTS
No automated system, bot, or artificial intelligence agent will be able to access, use, or interact with the Services without explicitly identifying themselves as such and complying with the technical identification requirements in each request. Spooky Vault reserves the right to block, limit, or restrict access to any Agent without prior notice.
SECTION 15 – RESCISSION
Spooky Vault reserves the right to terminate this agreement or a customer's access to the Services at any time, with or without prior notice and without requiring any justification. The customer will remain responsible for any outstanding amounts up to the date of termination.
The sections regarding Intellectual Property, Comments, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Applicable Law will survive the termination of this agreement.
SECTION 16 – DISCLAIMER OF WARRANTIES
The Services and products are offered "AS IS" and "SUBJECT TO AVAILABILITY," without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Spooky Vault does not guarantee that the use of the Services will be uninterrupted, timely, or error-free.
SECTION 17 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, Spooky Vault, its affiliates, employees, and suppliers will not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the use of the Services or any product acquired, including loss of profits, data, or income, even if such damages were foreseeable.
In no case will Spooky Vault's total liability to the customer exceed the amount actually paid for the product or service that gave rise to the claim.
SECTION 18 – INDEMNIFICATION
The client agrees to indemnify, defend, and hold Spooky Vault, its affiliates, directors, and employees harmless from any and all claims, losses, damages, or liabilities (including legal fees) arising from: (i) the breach of these Terms by the client, (ii) the violation of any law or third party right, or (iii) the use of the Services by the client.
SECTION 19 – Divisibility
If any provision of these Terms is found to be invalid or unenforceable, such provision shall be applied to the maximum extent permitted by law, and the remainder of these Terms shall remain in full force and effect.
SECTION 20 – RESIGNATION AND FULL AGREEMENT
The failure of Spooky Vault to exercise a right does not constitute a waiver of that right. These Terms, together with the policies published on the site, constitute the complete and binding agreement between the customer and Spooky Vault, superseding any prior understandings.
SECTION 21 – Transfer of Rights
The customer shall not assign or transfer their rights or obligations under these Terms without prior written consent from Spooky Vault. Spooky Vault, however, shall be free to assign, transfer, or delegate these Terms at any time, without prior notice or consent from the customer.
SECTION 22 – Applicable Law
These Terms shall be governed and interpreted in accordance with the laws of the jurisdiction in which Spooky Vault is legally incorporated, and which shall have exclusive jurisdiction over any dispute arising from these Terms, with the express waiver by the customer of any other applicable jurisdiction.
SECTION 23 – HEADINGS
The headings in this document are included solely for convenience and do not affect the interpretation of these Terms.
SECTION 24 – Amendments to the Terms
Spooky Vault reserves the right to update, modify, or replace these Terms at any time, by publishing the updated version on its website. It is the customer's sole responsibility to periodically review this page. Continued use of the Services after any changes have been published constitutes acceptance of those changes.
